A former girlfriend of one of the co-accused in the murder of Tim Bosma continued her testimony in a Hamilton courtroom Tuesday.
The court was shown a picture of a gun during the trial in the murder of Bosma. The gun was lying on a black cloth, and the photo was allegedly recovered from the BlackBerry of Mark Smich.
According to Smich’s ex-girlfriend, Marlena Meneses (pictured), the gun belonged to Dellen Millard.
The jury was told by Justice Andrew Goodman to disregard Meneses’ claim of the gun’s ownership, saying “it’s guess work.”
Under cross-examination by Smich’s lawyer, Tom Dungy painted Millard as “manipulative.”
Meneses described Millard as “creepy,” “controlling,” and a “user,” adding he would slap her “ass” and make sexual advances towards her. She says Smich warned her to “stay away because Millard will get you into trouble.”
Meneses says Millard tried to convince her to take part in serious criminal activity.
The court already learned of the abusive nature of Meneses and Smich’s relationship after she broke into tears while testifying that Smich wanted her to be a stripper so he didn’t have to work. She says he wanted her to get a job so Smich could “spend his days playing videogames and writing violent rap lyrics about others girls.”
Meneses told the court that Smich forced her to sell weed for him. He would use tricky scales and then have Meneses face buyers, knowing they were being ripped off.
Meneses testified that on May 6, 2013, she tried to talk her then-boyfriend, Mark Smich, out of stealing Tim Bosma’s truck. She thought he was doing it for money.
In the days following, Meneses told the court that Smich became scared and went into hiding. She said Smich would tell her, “Dell[en] did it. Dell murdered Bosma and incinerated his body.”
Meneses claims that Smich was surprised he “got stuck” with a toolbox containing the gun that allegedly killed Bosma. She says Smich duck-taped it and buried it, but she doesn’t know where.
30-year-old Millard, and 28-year-old Smich are on trial for the first-degree murder of Bosma, who disappeared May 6, 2013 after taking two men for a test drive in his pickup truck.
The Crown believes Bosma was shot point-blank in the truck and then incinerated.
